Notice of new “Bridging” Open Work Permits for Certain Federal Economic Class Applicants

    και

    Operational Bulletin 485 – December

    ____________________

You need to meet these requirements to apply under the Canadian Experience Class. You must:

    • plan to live outside the province of Quebec
    • have at least 12 months of full-time (or an equal amount in part-time) skilled work experience in Canada in the three years before you apply,
    • have gained your experience in Canada with the proper authorization
    • meet the required language levels needed for your job for each language ability (speaking, reading, writing, and listening).

    Skilled work experience

According to the Canadian National Occupational Classification (NOC), skilled work experience means:
    • Managerial jobs (NOC skill type 0)
    • Professional jobs (NOC skill type A)
    • Technical jobs and skilled trades (NOC skill type B)

You must have at least 12 months of full-time, or an equal amount in part-time, skilled work experience. Full-time work means at least 30 hours of paid work per week.

To find out which group your job falls under, see the list of jobs and their NOC groups. Follow the steps to find the NOC group that matches your job.

If the details and list of main duties for a job under NOC skill types 0, A or B match what you did while you worked in Canada, your job is likely in that group. If it does not, look at the list to see if another job matches your experience.

If your existing work permit is about to expire you may be eligible for a bridging open work permit. Bridging open work permits allow qualified applicants to keep working while they await a final decision on their permanent residence application.

    Principal applicant

If you are married or live with a common-law partner in Canada, and that person also meets the above conditions, you can decide which one of you will apply under the CEC as a principal applicant.
A common-law partner is a person who has lived with you in a conjugal relationship for at least one year. Common-law partner refers to both opposite-sex and same-sex couples.
If you are not sure if you should apply under the CEC, try the Come to Canada Wizard to find out if you would be eligible.

    Language

You must meet the minimum language requirements for your job. You must also include the results of a language test (from an agency designated by CIC) that shows you meet them when you apply. Your test results must not be more than two years old on the day you apply.

      INTRODUCTION

Effective September 17, 2008, the federal government introduceda new type of application for permanent residence called theCanadian Experience Class (CEC). The CEC was established in a bidto retain the top talent from abroad and overcome the excessivelylong processing delays many applicants experience when applying forpermanent residence status under the federal skilled workerprogram. This class of application allows temporary foreign workerswith work experience, and foreign students who are graduates of aCanadian educational institution who have acquired Canadian workexperience, to apply for permanent resident status on afast‐tracked basis (8 – 12 months) without having toleave Canada during the application process. The following is ahigh‐level overview of the requirements of the CECimmigration category.
      PASS/FAIL QUALIFICATION SYSTEM

Unlike the federal skilled worker program which is based on apoints system, qualification under the CEC is not discretionary.CEC selection is based on a pass/fail system where applicants mustmeet the minimum qualifying requirements for each criterion.
      MINIMUM QUALIFYING REQUIREMENTS

In order to qualify under the CEC, the foreign national mustmeet the following five minimum requirements:
      (a) The applicant must plan to live outside the province ofQuebec.
      (b) The applicant must have gained their experience in Canadawith a proper work or study permit.
      (c) The applicant must meet the minimum requirements under oneof the two below‐referenced streams:

      A. Temporary Foreign Worker Stream

The applicant must be a temporary foreign worker with at leasttwo years of full‐time skilled workexperience in Canada at the National Occupational Classification("NOC") Skill Type 0 (managerial occupations) or SkillLevel A (professional occupations) or Skill Level B (technicaloccupations and skilled trades). The work experience must be gainedwithin three years prior to applying. Work experience in severaloccupations may also be used. Full‐time work experience meansworking at least 37.5 paid hours per week.
Any periods of self‐employment or work withoutauthorization cannot be included in the required Canadian workexperience.

      B. Post‐Graduation Stream

      (i) The applicant must have been enrolled on a full‐timebasis in a post‐secondary program of study or trainingprogram for at least two years and have graduated from a Canadianpost‐secondary institution (for example, one year ofundergraduate study, plus a one year Master's program). Thereis no definition of "full‐time studies". It will beup to the post‐secondary institution to provide writtenconfirmation that the applicant studied on a full‐time basis. However, generally speaking, eight months is recognized asfull‐time study. Full‐time studies could also includeany period of training in the workplace which is part of a studyprogram.

(ii) The applicant must have acquired one year offull‐time skilled‐work experience at the NOC 0, A or Blevel in Canada within the two years preceding the date theapplication is made. Full‐time work experience means workingat least 37.5 paid hours per week. Work experience gained duringthe applicant's studies does not count toward meeting therequirements for work experience. This includes work performedunder an off‐campus work permit program or on a co‐opwork term. Only work experience gained after graduation under avalid work permit acquired after graduation will be considered. Therefore, the applicant must have worked under a validpost‐graduate work permit which can be obtained upongraduation and is valid for a period of up to 3 years.

      When to Apply?
The applicant must apply whileworking in Canada or within one year of leaving his or her job inCanada.

      Language Test:
Each applicant has to provideevidence that they meet the minimum language requirements accordingto their occupational skill level.
This means that an applicant who has qualifying Canadian workexperience at Skill Type 0 or Skill TypeA of the NOC must meet a language requirementbenchmark of 7 or higher for each of the languageabilities (writing, speaking, listening and reading) or6 for any one of the language abilities,7 or higher for any other two of those abilitiesand 8 or higher for the remaining ability. Eachapplicant who has qualifying Canadian work experience atSkill Type B of the NOC must meet a languagerequirement of benchmark of 5 or higher in each ofthe abilities, or 4 for any one of the abilities,5 or higher for any other two of the abilities and6 or higher for the remaining ability.
Each applicant is strongly advised to take the InternationalEnglish Language Testing System (IELTS) test as this examination isconsidered conclusive evidence of the individual's Englishlanguage abilities. Please note that language test results arevalid for two years from the date the examinationwas taken.
      WHERE TO APPLY?

An application made in Canada needs to be sent to CIC's visaoffice in Buffalo, United States:
Canadian Consulate General Immigration Regional ProgramCentre

Please see the following link for a list of Canadian VisaOffices: www.cic.gc.ca/english/information/offices/missions.asp.
      THE APPLICATION

The applicant will be sent a confirmation letter fromCitizenship and Immigration Canada once the application has beenreceived. This may take up to three months. If the applicant meetsthe minimum requirements set out above, the applicant may be askedto attend an interview with an immigration officer at the ConsulateGeneral of Canada in Buffalo, New York. Generally speaking, therequirement to attend the interview will only arise where it isunclear whether the applicant has met the minimum requirements setforth above. At the time of the interview, the applicant must havea valid passport or travel documents.
      FAMILY MEMBERS

An application made under the CEC can include theapplicant's spouse or common‐law partner and dependentchildren. The current processing times range from 8 – 12 months fromthe date of application.

      FEES

The applicant must pay the following fees, submitted in Canadianfunds:
      • A processing fee of $550.00, which must be paid at the time ofapplication and is non‐refundable even if the application isnot approved.
      • A fee of $490.00 for the Right of Permanent Residence, whichmust be paid before CIC issues the permanent resident visa. It isrefundable if the applicant cancels the application, theapplication is rejected, or if the applicant does not use thevisa.

Permanent Residence: New Requirements for the CanadianExperience Class (CEC):

The relentless Jason Kenney, Canadian Minister of Citizenship,Immigration and Multiculturalism, is also leading major reforms onthe Permanent Residence front. On January 2, 2013, the CanadianExperience Class (CEC) Program became more facilitative and is nowopen to foreign workers with only 12 months of Canadian workexperience, rather than 24 months under the former program. Inaddition, foreign students graduating in Canada can now earn therequired one year of work experience over a period of 36 months, rather than 24 months.

This increased flexibility has been well received by skilledworker applicants who now become eligible for permanent residenceat an earlier date. We understand that the Federal Government isplanning to accept an increasing number of permanent residentsunder this program that selects individuals with valuable Canadianwork experience and skills to benefit Canada's current labourmarket needs.

Eκεί έχω την εντύπωση πως μπορεί να υπάρξει γέφυρα πρίν να λήξει όμως το IEC.

Specific eligibility criteria – Federal skilled workers
                      A. Basic eligibility– Federal skilled workers

We can only process your application if you:

have one year of continuous full-time (or an equal amount of continuous part-time) paid work experience
in one of the eligible occupations within the last ten years, OR
have a valid offer of arranged employment, OR
are an international student who is enrolled in a PhD program in Canada (or who graduated from a Canadian PhD program within the past 12 months) and meet the factors below.

Also, no matter which of the three groups above you apply under, you must:

include the results of your official language test showing that you meet the minimum language threshold (Canadian Language Benchmark 7) in all four language skill areas (speaking, listening, reading and writing) when you apply, and
include either a completed Canadian educational credential or a completed foreign educational credential with an Educational Credential Assessment (ECA) from an approved organization, and
have at least one year of continuous full-time (or an equal amount in continuous part-time) paid work experience within the last ten years in the primary occupation you state in your application.

Remember that even if your application is eligible to be processed, you must meet all of the other FSW program requirements, such as meeting the pass mark on the selection grid and having enough money to support you and your family in Canada.

Six selection factors – Federal skilled workers

If you are eligible to apply as a federal skilled worker, we will assess you on a point system based on six selection factors.
                        Selection Factor Maximum points
                        English and/or French skills 28
                        Education 25
                        Experience 15
                        Age 12
                        Arranged employment in Canada 10
                        Adaptability 10
                        Total 100
Pass mark: 67 out of 100 points

If your score is 67 points or higher, you may qualify to immigrate to Canada as a federal skilled worker.

If your score is lower than the pass mark of 67 points, you will not qualify to immigrate to Canada as a federal skilled worker. It is better not to apply at this time.
                        Principal applicant

If you are married or you live with a common-law partner, either you or your spouse can apply as the principal (main) applicant.

Look at each selection factor and see which one of you is most likely to meet the eligibility requirements and earn the most points. That person should apply as the principal applicant. The other person would apply as a dependant.
