    New requirement to be invited to apply
    Intending migrants will have to submit an Expression of Interest through SkillSelect and be
    invited to apply for one of the new visas.
    Location requirements broadened
    Intending migrants, including dependent family members, may submit an Expression of
    Interest, be invited to apply, apply and have their application decided while in or outside
    Australia.
    Australian study or recent work experience requirements removed

    The recent work experience and Australian study requirements will be removed as eligibility
    requirements, though will remain as factors for receiving points under the points test. ,
    Revised eligible visa requirements
    Where the intending migrant is lawfully in Australia when lodging their application, it will no
    longer be necessary for them to hold a particular prerequisite visa, such as a student visa.
    People who hold a substantive visa, or a bridging visa A, B or C, will be eligible to apply if
    invited, provided they meet the other eligibility requirements.
    Basic eligibility requirements
    Many of the current points tested skilled migration visa basic requirements will continue
    under the new visa regime. At the time of invitationthe intending migrant (and their
    spouse/defacto partner if claiming points)
    -must be under 50 years of age
    -must have at least competent English
    -health, character and Australian values requirements must also continue to be met.

    Το σημαντικότερο απ'ολα είναι οτι δεν χρειάζεται πλέον να έχεις πρόσφατη προυπηρεσία για να μπορείς να αιτηθείς βίζα. Ακόμα δλδ και ένα άνεργος τα τελευταία 2 χρόνια μπορεί να αιτηθεί βίζα. Επίσης έχει αλλάξει και το point system και πλεον απαιτούνται 60 και όχι 65 πόντοι για ορισμένες βίζες όπως η 189,190 & 489. Επομένως το σύστημα γίνεται αρκετά ποιο ευνοικό για πολλούς πιστεύω!

    Παρακαλούνται οι φίλοι αναγνώστες να μην απαντήσουν στο αρχικό post, με διαφωνίες, παρατηρήσεις ή σχόλια αλλά μόνο εαν έχουν να προσθέσουν πληροφορίες σχετικά με τις αλλαγές στον μεταναστευτικό νομο.
    Επίσης καλό θα ήταν όποιος κάνει τον κόπο να γράφει για τις αλλαγές να παραθέτει και link προς τις σελίδες απο τις οποίες διάβασε τις νέες αλλαγές ώστε να υπάρχει και η σχετική επαλήθευση.
    Να θυμάστε οτι πολλοί συν-πατριώτες μας θα προσπαθήσουν να πληροφορηθούν για τις νέες αλλαγές, και οι περισσότεροι δεν θα γνωρίζουν σχεδόν τίποτα απο την σχετική ορολογία ή διαδικασίες, ετσι όποιος επεξηγεί κάτι καλό θα είναι να θεωρεί οτι οι αναγνώστες δεν έχουν καμία γνώση του αντικειμένου και ετσι να εξηγεί τα πάντα απο την αρχή.

        Οσες αιτησεις για onshore partner visa εχουν κατατεθει απο 24 Νοεμβριου και μετα ,η bridging visa που θα χορηγειται ,θα δινει πληρη δικαιωματα εργασιας ,που θα αρχιζουν μολις ληξει η τουριστικη βιζα.



        Ενω μεχρι πριν τις 24/11 η , bridging visa ειχε απαγορευση εργασιας και μονο με σχετικη αιτηση οπου εξηγουνταν οι λογοι ,μπορουσε καποιος να ζητησει να εργαστει.

                      The purpose of the 457 visa program is to enable employers to fill skill shortages by recruiting qualified overseas workers where they cannot find appropriately skilled Australians.
                      The 457 visa is a temporary visa, intended for filling short to medium term skill shortages, in a quick, flexible way to meet business needs. The program contains a number of in-built protections to prevent local workers' conditions from being undercut and overseas workers from being exploited.

                        Possible Subclass 457 changes for 1 July 2013

                        The Migration Amendment (Temporary Sponsored Visas) Bill 2013 which contains the framework for changes to the Subclass 457 expected to commence on 1 July 2013, is now before Federal Parliament.

                        The following is a summary of the amendments contained in the Bill.
                        NOTE: this Bill has not yet been passed and these may not be the final amendments.
                        Schedule 1 of the new Act - Purpose of temporary sponsored work visas
                        New Section 140AA of the Migration Act sets out that the purpose of a temporary sponsored work visa [the 400 series visas, which includes Subclass 457]:
                        to address genuine skills shortages without displacing employment and training for Australian citizens and permanent residents and “without the temporary sponsored work visa program serving as the mainstay of the skilled migration program”.
                        Ensure rights of sponsored workers
                        Impose obligations on sponsors to ensure:
                        - sponsored workers are protected
                        - the program is not used inappropriately
                        enable monitoring, detection, deterrence and enforcement in relation to any inappropriate use of the program
                        Schedule 2 of the new Act – Labour Market Testing
                        Labour market testing is defined as: in relation to a nominated position, means testing of the Australian labour market to demonstrate whether a suitably qualified and experienced Australian citizen or Australian permanent resident is readily available to fill the position.
                        Labour market testing is required for the approval of a nomination if:
                        • the approved sponsor is in a standard business sponsor]; and
                        • the sponsor nominates an occupation for the purpose of 140GB(1)(b); and
                        • a particular position, associated with the nominated occupation, that is to be filled by a visa holder, or applicant or proposed applicant for a visa, identified in the nomination; and
                        • it is not inconsistent with any international trade obligations of Australia [these may be indentified in legislative instrument]
                        Labour market testing will be satisfied if:
                        • The Minister is satisfied that the approved sponsor has undertaken labour market testing within a period [to be in a legislative instrument]; and
                        • The nomination is accompanied by evidence of that testing, and
                        • The evidence consists of one or more of:
                        Information about sponsor’s attempts to recruit suitably qualified and experienced Aust citizens or permanent residents to the position and any other similar position
                        - Advertising (paid or unpaid) commissioned or authorised by the sponsor
                        - Information about the sponsor’s participation in relevant job and career expositions
                        - Details of fees and other expenses paid (or payable) for any recruitment attempts
                        - Details of the results of recruitment attempts, including any position filled as a result
                        Copies of, or references to, any research released in the previous 6 months relating to labour market trends generally and in relation to the nominated occupation;
                        Expressions of support from Commonwealth, State and Territory government authorities with responsibility for employment matters;
                        Any other type of evidence determined by the Minister in a legislative instrument.
                        Labour market testing exemptions
                        Major disasters, natural or otherwise, where the Minister determines that it has such a significant impact on individuals that a government response is required, and, an exemption is required to assist disaster relief or recovery.
                        If a relevant bachelor degree and or 5 years experience is required for the nominated position AND the nominated occupation is specified in a legislative instrument
                        If a relevant associate degree, advanced diploma or diploma covered by AQF and or 3 or more years of relevant experience is required for the nominated occupation AND the nominated occupation is specified in a legislative instrument
                        Schedule 3 of the new Act - Subclass 457 visa conditions
                        Condition 8107(3)(b) and(3B)(b) will be changed to read:
                        If the Subclass 457 visa holder ceases employment with the sponsor, they period which they cease employment must not exceed 90 consecutive days. (up from 28)
                        This applies to visas in force before the commencement of this Act.
                        Schedule 4 of the Act – Sponsorship obligations
                        Sponsorship obligations set by the Minister may apply to all approved sponsors and former approved sponsors [no regulations for this yet] and must include, but is not limited to:

                        (a) paying a market salary rate (however described) to a visa holder;
                        (b) paying prescribed costs to the Commonwealth in relation to locating a former visa holder, and removing a former visa holder from Australia;
                        (c) paying prescribed costs of the departure of a visa holder (or a former visa holder) from Australia;
                        (d) complying with prescribed requirements to keep information, and provide information to the Minister;
                        (e) notifying the Department of prescribed changes in the circumstances of an approved sponsor, a former approved sponsor, a visa holder or a former visa holder;
                        (f) cooperating with the exercise of powers under or for the purposes of Subdivision F (which deals with inspector powers);
                        (g) ensuring that a visa holder participates in an occupation, program or activity nominated by an approved sponsor (including by preventing the on hire of a visa holder);
                        (h) requiring an approved sponsor or former approved sponsor not to transfer, charge or recover prescribed costs;
                        (i) requiring an approved sponsor or former approved sponsor to meet prescribed training requirements.
                        Schedule 5 of the Act - Enforceable undertakings by sponsors
                        [this applies to sponsorship obligations which arose before or after the commencement of this new Act]
                        Currently Section 140K (Sanctions for failing to satisfy sponsorship obligations) says that the Minister may bar sponsors from doing certain things or cancel the sponsorship approval.
                        The new Act will also allow the Minister:
                        to accept and undertaking under 140RA from the person to take specified action; or
                        to refrain from taking specified action;
                        or to provide a written undertaking to take specified action to ensure sponsorship obligations are not contravened
                        or if the person has breached an undertaking, apply for an order from an eligible court directing a person to comply with an undertaking, or to pay the Commonwealth an amount up the amount of any financial benefit they gained from a breach or to pay compensation to another person who suffered loss or damage as a result of a breach.
                        Schedule 6 of the new Act – Sponsorship inspection powers
                        Inspectors include Fair Work Inspectors
                        The powers of inspectors (as specified in Section 140X of the Migration Act) will include investigating whether a person who is required under subsection 140H(1) to satisfy a sponsorship obligation has committed an offence, or contravened a civil penalty provision, under Subdivision C of Division 12 of this Part.

                            Με προλαβες!Μολις μπηκα για να το ανεβασω! Αρα οι partner visas ,ειτε offshore ,ειτε onshore ,παραμενουν στα ιδια....αλλωστε ,δεν ηταν καθολου μικρη η αυξηση που μπηκε τον Γεναρη του 13...ειδικα για τις onshore.Aπο 2060$ σε 2680$ ανεβηκε τον Γεναρη η offshore και απο 3060$ σε 3975 $ η onshore.Oποτε απο 1η Ιουλιου , οι ιδιες τιμες για τις partner visas.
                            AUD2680 offshore , AUD 3975 onshore.

                            Kαι στις student visas ,δεν ειδα αυξηση.Παραμενουν στα AUD 535.

                            Oμως η Subclass 457 Visa/Temporary Work (Skilled) ,διπλασιαστηκε.Απο AUD455 ,πηγε στα AUD900,οπως ειχε ηδη εξαγγελθει οτι θα γινει και τους λογους που θα γινοταν.

                            υ.γ ομως μπηκαν αλλες χρεωσεις ,οπως τελικα φανηκε ,μετα το ποστ του billy ,oποτε γι αυτο μπηκα να γραψω αυτο το υ.γ εκ των υστερων. Μπηκαν χρεωσεις για καθε additional applicant στις περισσοτερες βιζες.

                              Changes to Visa Pricing Arrangements

                              From 1 July 2013, applicants might be required to pay the following charges when they lodge their visa application:

                              Base application charge – this charge is the amount a main visa applicant will have to pay for their visa application.

                              Additional applicant charge this charge will be paid by each additional applicant included in or added to a combined visa application (unless an exemption applies). The amount varies according to the age of the applicant and the visa subclass. This charge is added to the base application charge, the main applicant does not pay the additional applicant charge.

                              Non-internet application charge – a charge of AUD80 will apply for selected visas when the option to lodge and pay for the application online exists through our online service at Department of Immigration & Citizenship, but you choose to lodge a visa application using a paper visa application form, including fax, email, lodgement through a Service Delivery Partner (SDP), or in person. This charge is paid per application not per person.

                              This charge will initially be applied to the following five visa subclasses and more will be progressively included:
                              155 Five year Resident Return Visa
                              157 Three month Resident Return Visa
                              417 Working Holiday
                              476 Skilled (Recognised Graduate)
                              485 Temporary Graduate.

                              Subsequent temporary application charge – is a charge of AUD700 that you might need to pay when you lodge a visa application for certain temporary visas when you are in Australia.

                              This charge does not apply to the first visa that is granted when you are in Australia.


                              Why is the department introducing new charges?

                              The pricing restructure will bring Australia's visa pricing in line with similar countries such as Canada, the United States of America and the United Kingdom.


                              How are the new charges applied?

                              The new charges apply to most visa subclasses. From 1 July 2013, the charges that apply for a visa will be determined by:

                              the number of applicants in a combined application
                              the age of the individuals included in a combined application
                              the method used to apply for an application (by the Internet or paper or in person)
                              the application is lodged in Australia or outside Australia
                              previous visa application history.

                              How do I find out which charges apply to the visa I am applying for?
                              The Visa Wizard and the proposed Visa Pricing Table are tools you can use to assist you in determining the total charge of your visa application.

                              I submitted my visa application before 1 July 2013 and I have just heard there are new charges. Will I have to pay the new charges?

                              A valid visa application lodged and paid in full with the department before 1 July 2013 will not be affected by the changes to visa pricing.
                              Note: A visa application is not valid until we receive the correct total of the visa application charge. If less than the correct charge is paid, we cannot commence processing your visa application until the correct charge is received.

                              Why does my child have to pay the new additional applicant charge?
                              From 1 July 2013, the additional applicant charge will be applied to each additional visa applicant where there is more than one visa applicant in a combined visa application, unless an exemption applies.

                              I only had to pay a single fee for my visa and now I want to extend it and will be charged for everyone on the application. Why do I have to pay a different charge for this visa?
                              The new charges apply to all applicable visa applications lodged on or after 1 July 2013. This applies to new visa applications and extensions to current visas.


                              I added my child to my application after I lodged the original application. I have been advised that I must pay another charge for my child and the application will not be processed unless I pay the charges, why is this?
                              All applicants added to an application for a visa that is lodged on or after 1 July 2013 must pay the additional applicant charge, if it is applicable to that visa subclass.
