Work in Canada After Graduation with a Post-Graduate Work Permit

                  OCTOBER, 2013

International students in Canada have the opportunity, in many cases, to work both during their studies and after their educational programs have been completed. Many foreign students may apply for a post-graduate work permit after their studies in Canada, which allows them to gain valuable Canadian work experience that can lead to Canadian Permanent Residence.

What is a Post-Graduate Work Permit?

A post-graduate work permit is a work permit that an international student may apply for after he or she has finished a post-secondary educational program in Canada. It is an open work permit, meaning that the holder can work anywhere in Canada, for any company, and may change employers at any time during the validity of the post-graduate work permit.

The validity of a post-graduate work permit depends on the length of the educational program the international student has completed. For a program of study between 8 and 23 months, the permit will generally be issued for the same length of time as the period of study. Therefore, a 10-month program will usually result in a 10-month post-graduate work permit.

For programs two years or longer, a work permit can be issued for a maximum of three years. For example, a foreign student who finishes a four-year program would be eligible for a three-year post-graduate work permit, assuming he or she meets all other program requirements.

Who is Eligible for a Post-Graduate Work Permit?

In order to apply for a post-graduate work permit, an international student must have completed a full-time educational program in Canada, that lasted at least eight months, from one of the following:
                  • A public post-secondary institution (college, trade or technical school, university or CEGEP in Quebec);
                  • A private post-secondary institution which operates under the same rules and regulations as a public institution;
                  • In Quebec, a secondary or post-secondary institution which offers programs of 900 hours or longer than lead to either diplôme d’études professionnelles (DEP) or an attestation de spécialisation professionnelle (ASP); or
                  • Depending on the program of study, a Canadian private institution that has been authorized by provincial statute to confer degrees.

Before applying for a post-graduate work permit, the international student must have received written confirmation from his or her educational institution that the requirements to complete the academic program have been met. The application for the post-graduate work permit must be made within 90 days of receiving this confirmation, and the international student must still hold a valid study permit at the time he or she applies.

Each foreign student may receive only one post-graduate work permit, regardless of how many programs of study he or she has completed in Canada. The post-graduate work permit cannot be issued to students in distance-learning programs, or students participating in certain scholarship programs.

How can a Post-Graduate Work Permit lead to Permanent Residence?

An individual working in Canada on a Post-Graduate Work Permit has many opportunities to become a Canadian permanent resident. They differ depending on a variety of factors, such as the type of work an individual has completed, and his/her location in Canada.

Almost every province has one or more Provincial Nomination Program categories that specifically target international students who have completed their program of study and started working. Many of these programs require that the Canadian employer offer the individual a permanent job in their company.

If they cannot obtain a permanent job offer from their employer, international students on post-graduate work permits may have other options available to them. For example, the Post-Graduate Worker category of the Alberta Strategic Recruitment stream does not require a job offer from the employer if the program of study was completed in Alberta. In addition, international students who complete a program of study in Quebec and have a high-intermediate level of French may be eligible for the international student stream of the Quebec Experience Class without acquiring Canadian work experience. Ontario, British Columbia and Saskatchewan allow graduates of a Master’s or PhD program to be eligible for Permanent Residence without a job offer or work experience in Canada.

Another option for permanent residence is the Canadian Experience Class (CEC). To be eligible under this category, the applicant must have completed one year of full-time (or equivalent in part-time) work experience in Canada in a skilled position within three years of applying under the CEC. The applicant must also meet required language levels and intend to live in a province other than Quebec.

“Recent international graduates should use their post-graduate work permits to their full advantage,” says Attorney David Cohen, “Whether they choose to return home or to stay in Canada as permanent residents, graduates have a valuable opportunity to gain world class experience in Canada”.

International Students: Bring Your Loved Ones with You to Canada

Immigration Canada: International Students: Bring Your Loved Ones with You to Canada

Close to 100,000 international students from all over the world come to Canada each year to obtain a high-quality post-secondary education. Canada’s generous immigration policy allows the spouse and minor children of international students to accompany them to Canada to work and study. In this way, a student’s entire close family can benefit from a Canadian experience.

                    Spouse or Common-Law Partner

The spouse or common-law partner of an international student may apply for an open work permit. The student must be studying full-time at:
                    • A public post-secondary institution; or
                    • A private post-secondary institution that operates under the same rules and regulations as a public institution and receives half of its overall operations budget from government grants; or
                    • A private institution authorized by provincial statute to confer degrees.

An open work permit allows the holder to work for any employer in Canada, and does not require a Labour Market Opinion or job offer. The work permit will usually have the same period of validity as the study permit. However, the open work permit may exclude certain occupations in which the protection of public health is essential, unless the applicant undergoes an immigration medical examination.

In this way, not only can the spouses or partners of international students gain valuable Canadian work experience, but also can help support their families financially.

                    Minor Children

Any person under the age of majority is considered to be a minor child. The age of majority varies by province. In Alberta, Manitoba, Ontario, Prince Edward Island, Quebec, and Saskatchewan, the age of majority is 18, while in British Columbia, New Brunswick, Newfoundland and Labrador, Northwest Territories, Nova Scotia, Nunavut and Yukon it is 19.

Minor children who are already in Canada with at least one parent who is allowed to work or study in Canada do not require a study permit to attend school at the pre-school, primary, or secondary levels. However, once the child reaches the age of majority in their province, he or she must apply for a study permit to continue their studies in Canada.

                    The Application Process

An international student may bring his or her dependents to Canada by one of two routes.
One possible route is for the student and dependent family members to submit their visa applications concurrently. Another option is for the student to wait until he/she has received a study permit, and then submit applications for his or her accompanying dependents.

When applying for a study permit, information must be provided for all family members that will be accompanying the student to Canada. In order for their application to be approved, the student and his or her family will have to demonstrate that they have sufficient funds to support their stay in Canada. In addition, applicants may be required to undergo a medical examination and submit Police Clearance Certificates.

Depending on the applicants’ country of citizenship, a Temporary Resident Visa (TRV) may be required in addition to any study or work permits. A full list of countries requiring a TRV to enter Canada can be found here.

A spouse or common-law partner who plans to work while in Canada has the option to apply for his or her Open Work Permit before entering the country, upon arrival to Canada, or after entering the country.

Oftentimes, minor children entering Canada may receive a visitor record, even if the child will be studying in Canada. This is because minor children in Canada may study at the pre-school, primary or secondary levels without needing to secure a study permit.

                    The Final Word

Canada’s commitment to family unification means that international students and their families have the opportunity to experience Canadian life together. Whether it is for a few months or for several years, international students will be comforted to know that their loved ones can be nearby as they pursue their dreams of obtaining a Canadian education.
“Canada is home to some of the most distinguished colleges and universities in the world,” said Attorney David Cohen. “Aside from putting money into the Canadian economy while studying, many international students remain in Canada after graduation and become valuable members of our workforce and general society. It is only natural that the Canadian Government has established generous laws that allow them to stay close to their families and feel welcome in their new home.”

Working While Studying in Canada: Options for Students

Canada Immigration News - Working While Studying in Canada: Options for Students

                        SEPTEMBER, 2013

There are a number of possible options for international students to work while pursuing their programs of study in Canada. Depending on a student’s situation, s/he may be eligible to work on-campus, off-campus, or as part of an internship or co-op program. In addition, the spouses of international students can usually work in Canada if desired.

                        Working On-Campus

A foreign student does not need a work permit in order to work on-campus at a post-secondary educational institution in Canada. However, the student must hold a valid study permit, and be studying full-time at one of the following:
                        • A public post-secondary institution; or
                        • A private post-secondary institution that operates under the same rules and regulations as a public institution and receives half of its overall operations budget from government grants; or
                        • A private institution authorized by provincial statute to confer degrees.

Most post-secondary institutions in Canada have career and placement services offices that can help students find and apply for on-campus jobs. In addition, there may be online job postings for specific faculties that will help students find jobs in specific fields of study.

                        Working Off-Campus

An international student requires a work permit in order to work off-campus. In order to be eligible for an off-campus permit, the student must be studying full-time at a participating, publicly funded educational institution or eligible privately funded institution. A list of eligible institutions can be found here.
It is important to note that students enrolled in some programs at private institutions will not be eligible to work off-campus. Students enrolled in private institutions should contact their schools directly to determine if their programs meet requirements.
Students who hold off-campus work permits may work up to 20 hours per week during the academic season. During breaks such as winter and summer holidays and spring break, they are permitted to work full-time. International students cannot begin to work off-campus until they have received work permits, and they must maintain status as full-time students in good academic standing in order to continue working.
Before applying for an off-campus work permit, a student must have studied for six months out of the year preceding their application. For more information, please click here.

                        Internship or Co-op Program

Some post-secondary educational programs include work experience as an important component of their curriculums. In these cases, the work being completed is considered a co-op or internship. In order to participate in a co-op or internship, international students need work permits in addition to their study permits.
To apply for a work permit, a student must hold a valid study permit, their intended employment must be an essential part of their academic program in Canada, and the employment must be a required component of the program. The employment requirement must be certified with a letter from a responsible academic official of the institution. In addition, the internship or co-op cannot constitute more than half of the total program of study.

                        Open Work Permits
for the Spouses of International Students

The spouse or common-law partner of an international student is eligible to apply for an open work permit. The foreign student must hold a valid study permit and be studying full-time at one of the following:
                        • A public post-secondary institution; or
                        • A private post-secondary institution that operates under the same rules and regulations as a public institution and receives half of its overall operation sbudget from government grants; or
                        • A private institution authorized by provincial statute to confer degrees.

The spouse’s open work permit will be valid for the same period as the study permit issued to the international student. The accompanying spouse or common-law partner is not required to obtain a job offer before receiving an open work permit.

                        Benefits of Working while Studying

In addition to the extra income, working in Canada may help students who plan to work or immigrate after their studies.
“Canada has a generous policy of allowing foreign students to work during their studies in Canada,” said Attorney David Cohen. “Not only does this allow these students to gain valuable Canadian work experience; it helps them to establish contacts for post-graduation employment. Such employment may later help them in an application for Canadian Permanent Residency.”
Working in Canada on a post-graduate work permit may enable students to apply for Canadian Experience Class, Quebec Experience Class, or one of the many Provincial Nomination Programs. Many of these programs have been created with facilitating Permanent Residency for foreign graduates in mind.
